The Mental Health Court decides the state of mind of people charged with criminal offences.The court hears matters in Brisbane and also conducts hearings via videoconferencing.. A criminal case can be referred to the Mental Health Court if it is believed that the alleged offender: is mentally ill was mentally ill has an intellectual disability; and at the relevant time was deprived of a relevant capacity (Criminal Code Act 1899, s. 27). The court will decide if the alleged offender was of unsound mind when they committed the offence.
